Tajdeed Terms & Conditions

Effective date: [PLACEHOLDER: date of publication]Last updated: [PLACEHOLDER: date of publication]

1. Acceptance of these terms

By creating an account, accessing, or using Tajdeed (the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the Platform. These Terms apply to all users, including Guests, Shops, and Admins as defined below.

2. Definitions

  • "Tajdeed," "we," "us" - [PLACEHOLDER: full legal entity name], the operator of the Platform.
  • "Platform" - the Tajdeed website, admin dashboard, desktop application, and related services.
  • "User" - anyone who accesses or uses the Platform, in any role.
  • "Guest" - an end user who receives or looks up a device certification.
  • "Shop" - a registered repair shop authorized to issue certifications and, where enabled, purchase through Tajdeed Retail.
  • "Admin" - Tajdeed personnel with administrative access to the Platform.
  • "Certificate" - a record issued through the Platform attesting to the inspection and condition of a specific device, as assessed by the issuing Shop.
  • "Tajdeed Retail" - Tajdeed's parts-supply service enabling Shops to order repair parts through the Platform.

3. Description of the service

Tajdeed is a certification-first platform: its core function is enabling Shops to inspect devices and issue Certificates that Guests and other parties can rely on and verify. Tajdeed Retail is a supplementary service through which Shops may purchase parts.

Tajdeed is not a marketplace for buying/selling devices between Guests, and does not itself inspect, repair, or take possession of devices. Certificates reflect the assessment of the issuing Shop; Tajdeed provides the platform and record-keeping infrastructure but does not independently verify each Shop's inspection.

4. Eligibility and accounts

  • You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account.
  • Shops must provide accurate business information and complete any verification steps Tajdeed requires before issuing Certificates.
  • You are responsible for maintaining the confidentiality of your login credentials and PIN, and for all activity under your account. Notify us immediately at [PLACEHOLDER: security contact email] if you suspect unauthorized access.
  • Tajdeed may suspend or terminate accounts that provide false information or fail verification.

5. User roles and responsibilities

5.1 Guests

  • May view/verify Certificates associated with a device.
  • Are responsible for independently deciding whether to rely on a Certificate for any transaction (e.g., purchasing a used device from a third party).

5.2 Shops

  • Must perform inspections honestly and to a reasonable professional standard before issuing a Certificate.
  • Are solely responsible for the accuracy of the information they submit and the assessments they make.
  • Agree not to issue Certificates for devices they have not actually inspected.
  • Are responsible for complying with applicable Algerian commercial and consumer protection law in their own dealings with customers.

5.3 Admins

  • Tajdeed personnel operating under internal policies; not third-party users for purposes of these Terms.

6. Certificates: what they mean and their limits

A Certificate reflects the issuing Shop's assessment of a device at a specific point in time. Tajdeed does not guarantee, warrant, or independently verify the accuracy of any Shop's inspection or the ongoing condition of a device after certification. A Certificate is not a guarantee against future defects, and is not a warranty from Tajdeed.

Any dispute about the accuracy of a Certificate's contents is between the Guest and the issuing Shop; Tajdeed's role is limited to providing the record-keeping and verification infrastructure. [PLACEHOLDER: confirm whether Tajdeed wants to offer any dispute-mediation process between Guests and Shops, or explicitly disclaim involvement beyond this.]

7. Tajdeed Retail (parts supply)

  • Tajdeed Retail allows Shops to order repair parts through the Platform.
  • Product listings, availability, and pricing are as shown at time of order and may change without notice.
  • [PLACEHOLDER: clarify fulfillment model - does Tajdeed hold inventory, or is this a pass-through/dropship arrangement with suppliers? This materially changes liability language and needs to be accurate.]
  • Orders are subject to the payment, refund, and cancellation terms in Sections 8–9.

8. Payments and fees

  • All payments on the Platform are processed through Chargily Pay. Tajdeed does not directly collect or store your full payment card details.
  • Certification fees, subscription fees (if any), and Tajdeed Retail prices are as displayed on the Platform at the time of the transaction. [PLACEHOLDER: describe actual fee structure - per-certificate fee, Shop subscription, commission on Retail sales, etc.]
  • You are responsible for any taxes applicable to your use of the Platform or purchases made through it.
  • Failed or disputed payments may result in suspension of the associated service (e.g., a Certificate not being finalized, or a Retail order being held).

9. Refunds and cancellations

[PLACEHOLDER: this section needs your actual policy - draft placeholder below assumes a standard reasonable default; replace with your real policy.]

  • Certification fees: generally non-refundable once a Certificate has been issued, except where Tajdeed determines the Certificate was issued in error due to a Platform malfunction.
  • Tajdeed Retail orders: may be canceled before [PLACEHOLDER: shipment/fulfillment], subject to a refund via the original Chargily Pay payment method. Defective or incorrect items may be returned within [PLACEHOLDER: X days] of receipt.
  • Refund requests should be sent to [PLACEHOLDER: support email] and are processed within [PLACEHOLDER: X business days].

10. Prohibited uses

You agree not to:

  • Provide false information when registering as a Shop or issuing a Certificate
  • Attempt to forge, alter, or duplicate a Certificate
  • Use the Platform to facilitate fraud, including certifying stolen devices
  • Attempt to bypass, probe, or interfere with the Platform's security (including authentication, rate-limiting, or payment systems)
  • Use the Platform in violation of applicable Algerian or international law
  • Resell or redistribute access to the Platform without authorization

Violation may result in suspension or termination of your account, and may be reported to relevant authorities where it involves fraud or illegal activity.

11. Intellectual property

The Platform, including its software, design, branding, and content (excluding user-submitted data such as Certificate details), is owned by Tajdeed or its licensors and protected by applicable intellectual property laws. You may not copy, modify, or create derivative works of the Platform without our written permission.

You retain ownership of the data you submit (e.g., business information, certification records), and grant Tajdeed a license to use it as necessary to operate the service described in these Terms and our Privacy Policy.

12. Disclaimers and limitation of liability

To the maximum extent permitted by law:

  • The Platform is provided "as is" and "as available," without warranties of any kind, express or implied.
  • Tajdeed does not warrant that the Platform will be uninterrupted, error-free, or secure at all times.
  • Tajdeed is not liable for the accuracy of any Shop's inspection or Certificate content, or for disputes arising from a device's actual condition versus its Certificate.
  • To the extent permitted by law, Tajdeed's total liability for any claim arising from use of the Platform is limited to the amount you paid to Tajdeed in the [PLACEHOLDER: e.g., 6 months] preceding the claim.
  • Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., liability for fraud or willful misconduct).

13. Indemnification

You agree to indemnify and hold Tajdeed harmless from claims, damages, or expenses arising from your breach of these Terms, your use of the Platform, or (for Shops) the accuracy of Certificates you issue.

14. Termination

  • You may close your account at any time by contacting [PLACEHOLDER: support email].
  • Tajdeed may suspend or terminate your account for violation of these Terms, suspected fraud, or as required by law.
  • Certificates already issued remain valid records after account termination unless found to be fraudulent.

15. Dispute resolution and governing law

These Terms are governed by the laws of [PLACEHOLDER: state of LLC formation], without regard to conflict-of-law principles, except where mandatory Algerian consumer protection law applies to users located in Algeria. [PLACEHOLDER: decide and confirm dispute forum - e.g., binding arbitration in a specific location, or courts of a specific jurisdiction. This is a meaningful legal choice a lawyer should weigh in on given your Algeria-US structure.]

16. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated via email or Platform notice before taking effect. Continued use after changes take effect constitutes acceptance of the updated Terms.
